Healthcare proxies for LGBTQ+ people are 10x more likely to be challenged by biological family members than equivalent documents for heterosexual couples — not because the documents are weaker, but because hostile biological family with lawyers is a documented pattern. Without a healthcare proxy, medical decisions default to next-of-kin under state law — which in many states means the exact people the person was estranged from.
