BetterHelp paid $7.8 million in FTC settlements in 2023 for sharing therapy users' mental health data with Facebook and Snapchat for advertising — and in May 2024, 800,000 affected customers received refund checks averaging under $10 each. The FTC's 2024 Health Breach Notification Rule update explicitly classified sharing health data with advertisers as an unauthorized disclosure. HIPAA doesn't cover consumer mental health apps — BetterHelp, Calm, Headspace, and Talkspace are not subject to HIPAA and can share your data with anyone their privacy policy allows. 29% of LGBTQ+ adults report poor or bad mental health vs. 10% of non-LGBTQ+ adults — nearly triple the rate. 35% wanted but could not afford mental health care.
