14 states have total or near-total abortion bans as of 2026. 412+ people have been charged with abortion-related crimes since Dobbs — the prosecution vector is digital evidence, not physical. In the Nebraska Burgess case, Facebook Messenger private messages between a mother and daughter were obtained by law enforcement via a Facebook subpoena and used as evidence in a criminal prosecution. This is the documented threat model: period tracker data, search history, location data, and private messages are all subpoenable. The National Abortion Federation cut its emergency fund from $6M to $3M in 2024, reducing the average grant from $700 to $250 — the funding infrastructure is under pressure at the same time legal access is collapsing. Aid Access continues to operate, mailing medication abortion to all 50 states including ban states, under a model that has so far survived legal challenge. 19 states have shield laws protecting providers and helpers; shield law navigation requires knowing which state's law covers you.
